1 Purpose of this Privacy Policy

This Privacy Policy has been produced to list down about how PassApp Technologies ("PassApp") and its ride hailing service/app will be referred as “PassApp”, “PassApp App”, “us”, “we”, “our”.

This privacy is used to apply on the Personal Data of our member (“driver”) referred as “you”, “your” that has been provide to us.

By providing your Personal Data, you hereby agree and consent to us handling your Personal Data in the manner set forth in the prevailing Privacy Policy which may be updated or modified from time to time.

This Privacy Policy does not affect any rights which we may have at law in connection with the handling of your Personal Data. We may from time to time update this Privacy Policy. You agree to be bound by the prevailing terms of the Privacy Policy as updated from time to time.

2 Collection of Personal Data

2.1 General Terms

"Personal Data" means information about you, from which you are identifiable, including but not limited to your name, nationality, address, telephone number, bank details, credit card details, gender, resident status, financial background, personal interests, email address, your occupation, your photo, your current location, any information about you which you have provided to us in registration forms, application forms or any other similar forms and/or any information about you that has been or may be collected, stored, used and/or processed by us from time to time through the use of our app, and includes sensitive personal data such as your identification card number, driving license number, birth certificate number, passport number, race, ethnic origin, date of birth, marital status, education background, and data relating to health, religious or other similar beliefs.

You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. For the avoidance of doubt, any provision of data to us is voluntary. If you do not provide your Personal Data, we may not be able to provide the services as set out at sections 3 and 4 below.

2.2 Personal Data collected from Drivers

We may also collect telematics data, including but not limited to your accelerometer data, GPS data, braking data and all such data collected when your PassApp App is logged-on, accessed and/or used.

We are using your location which is including in foreground and background mode for the following task:

• To know your current location which is allow us to provide the job offer to you.
• To Calculate the price. Because we are doing the booking meter which is calculate base on the actual of your driving distance.

2.3 Personal Data collected by Drivers

Certain Drivers of PassApp may uses personal in-vehicle cameras for their own safety and security purposes. Whilst the use of such in-vehicle cameras are neither endorsed nor prohibited by PassApp, PassApp does not collect, use or disclose any of your Personal Data from such in-vehicle recordings. The collection, use and disclosure of any such Personal Data is not conducted on behalf of PassApp.

The collection, use and disclosure of Personal Data obtained from personal in-vehicle cameras is solely the responsibility of the Drivers and Users should inform their Drivers if they have any objections to the use of personal in-vehicle cameras in such vehicles.

3 Handling of Personal Data

3.1 General Personal Data

PassApp may handle the Personal Data we collect from you for the following purposes:

• processing account application and/or renewals (where applicable) etc;
• matching any Personal Data held which relates to you for any of the purposes listed herein, including for purposes of matching Users with Drivers in order to provide ride-hailing services requested through (s);
• responding to your queries, requests, feedback and complaints;
• verifying your identity;
• compliance with internal policies and any applicable rules, laws and regulations, codes of practice or guidelines or request from any governmental, supervisory, regulatory, judicial or equivalent body, or to assist in law enforcement and investigations by relevant authorities;
• as reasonably required for the provision and/or receipt of third-party services;
• managing PassApp's relationship with you, personalizing your experience and to allow us to deliver the type of content and product offerings in which you are most interested;
• improving our service in order to better serve you

3.2 Location

We are using your location which is including in foreground and background mode for the following task:

• To know your current location which is allow us to provide the job offer to you.

4 Disclosure and/or transfer to third parties

PassApp does not sell, trade, or otherwise transfer to outside parties your Personal Data without your consent.

Subject to the provisions of any applicable law, certain Personal Data may be disclosed and/or transferred for the purposes listed in sections 3 and 4 (where applicable) to the following third parties:

• the respective User and Driver in relation to the matched ride-hailing service provided on the PassApp App, only to the extent that the Personal Data is necessary for completing the ride-hailing service
• PassApp's affiliates
• our professional advisors such as our auditors and lawyers
• relevant governmental, regulatory, supervisory or judicial or other equivalent bodies or authorities or law enforcement agencies
• any third parties to whom we are required by or requested to or under any obligation to disclose and/or transfer Personal Data pursuant to law or regulation or any legal process
• any other party to whom you authorize us to disclose and/or transfer your Personal Data

5 Protection of your Personal Data

PassApp will take reasonable steps to protect your Personal Data against unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks. We have implemented appropriate measures to ensure that, by default, only Personal Data that is necessary for the specific purpose is processed.

We have implemented a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your Personal Data. All transactions are processed through a gateway provider and are not stored or processed on our servers.

The additional protective measures have been adopted:

• regular malware scanning conducted;
• storage of Personal Data in secured networks that is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential; and
• encryption via Secure Socket Layer (SSL) technology for sensitive information you supply.

Where necessary, PassApp will also assess the impact of processing on the protection of personal data in certain circumstances, including where the processing (particularly the use of new technologies) is likely to result in high risk to the rights and freedoms of yourself.

6 Balance Policy

You agree that we may do any of the following, at any time, without notice:

• Your balance in wallet 01 will be set to zero if you do not do any top-up up within 180 days from the last top-up.

7 Suspension and Termination

You agree that we may do any of the following, at any time, without notice:

• To suspend access to your Account that no activities from over 90days
• គ្មានសកម្មភាពទាក់ទងនឹងការប្រើប្រាស់កម្មវិធីរយៈពេល ១៨០ថ្ងៃ គណនីនឹងត្រូវបិទដោយជោគជ័យ ទឹកប្រាក់ដែលនៅសល់នឹងធ្វើការកាត់ចេញពីក្នុងគណនី លេខទូរស័ព្ទដែលភ្ជាប់គណនីក៏មិនអាចប្រើប្រាស់ជាមួយក្រុមហ៊ុនបន្តបាន។
• To terminate your account that no activities from over 180days
• ទឹកប្រាក់ដែលនៅសល់មិនត្រូវបានបង្វិលទៅអោយអ្នកបើកបររិញទេនៅក្នុងករណីផ្អាកការប្រើប្រាស់ជាបណ្ដោះអាសន្ន រឺ ការបិទគណនីជារៀងរហូត។
• We shall not be required to compensate you for any suspension or termination.

8 Changes to the Privacy Policy

We may update this Privacy Policy from time to time at PassApp's absolute discretion. Subject to your rights at law, you agree to be bound by the terms of the Privacy as revised and updated from time to time on this website.
